Develop Written Contract for Provision of Emergent EMS Services
Providing Emergency Medical Services in a defined response area to a political subdivision, organization or group of individuals may be accomplished in several different ways. Services may be supplied based on a pre-existing agreement, consolidation of jurisdictions, financial benefit/burden or in effort of community support to protect lives. In most states these services are defined by law, ordinance or code that affords the provider with certain immunities and responsibilities. When the provider is an outside agency or private organization; these dynamics are not automatic and must be clearly defined.
During a recent risk control survey; it was noted your organization provides emergency medical services response to one or more jurisdictions that fall into the above categories.
We recommend that these services be provided under a written contract or agreement that includes but is not limited to the following stipulations:
- Description of Services Provided
- Service area defined
- Scope and level of care provided
- Responsible Parties for Billing
- Provisions for peak times
- Statements of Indemnity
- Length of contract
- Perpetual terms or renewal dates
- Termination statement
We further recommend your organization consult with legal counsel on this and any other written agreements.
