Develop Durable Medical Equipment (DME) Waiver

Durable medical equipment (DME) costs are on the rise.  People on fixed and limited incomes have an increasingly more difficult time affording the purchase of these items.  Programs that loan durable medical equipment are a tremendous benefit to the community, but they are not immune from the liabilities associated with such programs.

During the recent Risk Control Survey, it was noted your organization receives donated durable medical equipment and loans it to members on the community on a short term basis.  While your service does assess and clean the equipment, it is not inspected by a trained biomedical repair vendor. 

We recommend your organization amend the current rental agreement to include language that provides the equipment is rented “as is” and provides a waiver of liability.  It is recommended your organization have this agreement reviewed by legal counsel in order to assure that it is as effective as possible for the needs of the organization.
